Although it is not a legal requirement to send a Preliminary Notice as a general contractor, it is the best business practice to do so for Ohio projects. Sending a notice advises all parties that you are working on the residential project and helps you get paid faster.
An Affidavit of Mechanic's Lien must be filed by the general contractor within 60 days of last furnishing labor or materials residential Ohio project.
A Notice of Furnishing is required for the subcontractor within 21 days of first furnishing labor and/or materials or from the date the Notice of Commencement is filed. You may request a Notice of Commencement by certified mail and the owner is required to send a copy within 10 days. If a Notice of Commencement is not filed, the subcontractor does not have to give a Notice of Furnishing for Ohio residential projects.
