1. How long do I have to file a claim of lien in Montana?

2. Do I have to file any notices before I start work on a property in?

No, but a Notice of the Right to Claim a Lien served to the contracting owner within either 20 days or 45 days after the date in which services were first performed.

3. Is there any mandatory notice requirement in Montana?

The claimant must serve the owner of the property with a copy of a Construction Lien claim.  The owner is allowed to file a Notice of Completion.

From the filing date, there is a period of 2 years to foreclose a Claim of Lien

 

7. What costs can I not claim for?

Attorney’s fees, interest, or  damages cannot be included in the lien amount.

A preliminary notice to the prime contractor must be given within 30 days of first providing services.

A bond of claim must be filed within 90 days of completing the project. Enforcement of suit is due within 1 year from when the cause of action came up. Or when the contracted agency made a settlement to handle claims is within 1 year from the when the final decision of procedure was made available.
