Notice to Contractor and Mechanics Lien 

 

1. How long do I have to file a claim of lien in Missouri?

6 months after the last day labor or materials were furnished on the property

 

2. Do I have to file any notices before I start work on a property in Missouri?

Yes, contractors must notice to the owner before delivery of materials, first payment, or start of the contract. 

 

3. When is my last day of work so that I can file a lien to get paid?

The last day labor or materials are furnished in fulfillment to the contract. 

 

4. Do I have any lien right in the state of Missouri?

Anyone that furnishes labor, materials or equipment for use in improvement of real property, is entitled to lien rights. Rental equipment, professional design, engineering, or surveying services.  As long as your provide service to the property you are able to lien the property for payment, with certain limitations to each.

 

5. How long do I have to file for a lien of foreclosure?

Within a 6 month timeframe, after your lien was filed.

 

6. Can I File a Lien if I’m Unlicensed?

Only if the services required does not require a license to perform. 

7. Who satisfies the lien when I get paid?

When the claim is paid, the lien claimant is required to file a Release of Mechanic’s Lien statement in the circuit court in which the lien was filed.  This should be done within 10 days or it may result in a claim for damages.

 

8. What cost or damages am I not able to claim for?

Attorney fees, equipment not attached to the building, and equipment suppliers who do not provide a Notice to Owner on claims more that $5,000.
