5. How long do I have to file for a lien of foreclosure?

The time frame is 1 year from the date the lien of notice was filed.  The owner can shorten the time by, sending a statutory 30 day Notice to Foreclosure.

6. Is there any mandatory notice requirement in Indiana?

Yes, a Sworn Statement and Notice of Intention to Hold Mechanic’s Lien, must be filed.

A bond claim must be filed from the last day of furnishing services to the project. Lawsuit on general state owned properties must be filed within 1 year from substantial completion. State university and other state projects must be filed within 60 days from substantial completion. Department of Transportation projects must be filed within 90 days of receiving notice of rejection of the claim.
