A Preliminary Notice commonly known as a “Notice of Retention” should be filed by the twentieth day on the project and on the website of  www.scr.utah.gov

Not Required

If a “Notice of Completion” is filed the deadline to record the lien is ninety days (90) from the last day on the project.  If NO ”Notice of Completion” is filed the deadline to record the lien is one hundred eighty days (180) from last day on the project.

1. How long do I have to file a claim of lien in Utah?

Anyone claiming for a Preconstruction Services Lien, must file within 90 days after the completion of their services required.  Anyone claiming for Notice of Construction Lien,  must file within 180 days after the completion of their services required.

2. Do I have to file any notices before I start work on a property in Utah?

Any party with preconstruction services, must file within 20 days a Notice of Retention.  Any party with construction services must file within 20 days a Preliminary Notice.

3. Who has lien rights in the state of Utah?

Anyone who provided services to the property which contributed to the improvement of the property are entitled to lien rights.

 

4. How long do I have to file for a lien of foreclosure?

Within 180 days after the day a Notice of Preconstruction Lien or Notice of Construction Lienwas filed.
