1. Do I have to file any notices before I start work on a property in New York?

During the project a Notice for Account of Public Improvement may be filed, or within 30 days after the completion of the project.

2. When is my last day of work so that I can file a lien to get paid?

The courts look at the last performed work or materials furnished by the claimant.  Warranty work or remedial work performed will not extend the time frame for filing a Notice of Lien.

3. Who are not protected by the lien law in the state of New York?

If the work requires the contractor to be licensed but they are not, they cannot lien the property.  Third tier and lower subcontractors cannot file a lien on a public works project.  A supplier to a supplier cannot file a lien on private or public project.

4. How long do I have to file for a lien of foreclosure?

Public and private improvement liens expire 1 year after filing.  A lien foreclosure action must be started before the lien expires.

5. Is there mandatory notice requirements in New York?

New York does not have mandatory notice requirements.  The Lien Law, does specify items that must be in the Notice under Mechanic’s Lien Law for Account of Public Improvement to obtain a valid lien.  Additional Notices must be filed later.

6. Who satisfies the lien when I get paid?

The lienor must provide a certificate stating that the lien is satisfied or released.

7. What cost can I claim for?

The lien is limited to the agreed price of labor performed or materials furnished of the filing of the lien.  The lien may include materials manufactured, but not delivered to the project. Lost profits or damages cannot be included.
